毕业生英语四级未过关不发学位证 状告母校

核心提示：新疆伊宁一名大学生，由于在校未通过英语四级，没有拿到学位证，导致失业。6月29日，杨茂余的代理陈小平律师向伊宁市人民法院递交了诉状，要求被告授予原告学士学位证书。目前法院已经立案，此案将在本月17日开庭。

12杨茂余这段时间几乎背熟了学生守则上关于学位授予的条款

7月4日是杨茂余必须离校的日子。找房子、打包行李，一切都显得仓促。从早上奔波到下午，杨茂余一无所获。一间卧室200多元，“告学校的500元律师费都是借来的”。他只好暂时跟同学挤住在一起，“先凑合着，等着开庭”。

静下心来，杨茂余开始冷静回顾自己是如何走到非要跟母校对簿公堂这个地步的：

6月19日之前，杨茂余还在伊宁市一家种子公司实习。因为是在两次面试后被通知来实习的，杨茂余明白，公司对自己是满意的，他自己也认为公司发展前景不错，是否留在公司上班，双方只差一纸约定。

理工科的杨茂余有点偏科，化学专业课的成绩很出彩，但英语不理想。这在他的国家英语考试成绩上体现了出来。2008年，杨茂余参加了四级英语考试，考了321分。“这个分不高，但当年我们院毕业生获取学位证的标准是320分，我还超了一分。”

6月19日，学校贴出了2009届本科毕业生预授予学位公示名单，在1473个名字里中，杨茂余没有找到自己的名字。4天后，化学和生物学院贴出的名单中，杨茂余位列“不授予学位”之中，“不授予原因”一栏注明为“大学英语成绩321分”。

杨茂余急了，化学和生物学院给他的解释是，学校的标准是320分，但该院划定的标准要高一些，是328分，杨茂余的成绩不达标。

6月21日，种子公司经理通知杨茂余等新进的大学生，带上毕业证和学位证与公司签约。就这样，杨茂余失业了。此后，他又找了两家公司应聘，但对方都要求要有学位证书。

向校方求情 碰了一鼻子灰

6月22日，星期一。杨茂余找到院里的领导，请老师能考虑他其他方面的表现给自己补授学位证，院里的领导不同意。

杨茂余并不认同院里关于学位授予的限制条件，他认为学位证的颁发应当完全遵照本校学生手册上《本科学生学士学位授予细则》的相关规定来执行。该校2006年版的学生手册上对学位证的授予和不授予分别做了规定，其中用成绩量化的条款中除了对平均学分绩点要求为2.0之外，没有对英语成绩作出要求。

见学院无法通融，杨茂余又找到学校领导。杨茂余被告知，学校关于绩点2.0、英语成绩320的规定只是一个基础，各院(系)有在此基础上根据学生总体水平制定更高标准的自主权。

6月24日，杨茂余第三次找到化学和生物学院院长欧阳艳，但请求依然被拒绝。杨茂余抱着最后的希望打算找一次校长，但这次他只见到了校长助理。他确认自己已经完全没有机会拿到学位证了。杨茂余决绝地说：“那我只好通过法院来解决了。”对方回应：“那是你的权利。”

6月25日，伊犁师范学院举行毕业典礼。杨茂余起了个大早，去律师事务所咨询起诉母校的相关事宜。

6月26日，各班班长召集全班同学发毕业证和学位证。全班67人仅杨茂余等5名学生没有拿到学位证，只拿到了毕业证，杨茂余心里很不是滋味。

当天，杨茂余所在的化学2班租了两套学士服，大家纷纷穿上照相留念，杨茂余也穿上学士服做出一副开心的模样照了相。他说：“大学四年，几乎每个人都期待着穿上学士服的这一天，我只是因为一些不成文的规定丧失了这个身份而已。”

与英语挂钩 校方有自己的理

杨茂余认为：学位证不该与英语四级考试挂钩，不论是国家学位条例还是学校的学生守则都没有明文规定;即使有约定俗成的规定，学校也应当尽早告知分数线，不应当在临近毕业时才公布新的评分标准。“我是2008年参加的四级考试，这个成绩超过学校要求的毕业生获取学位证的320分的标准。但现在要毕业了我才知道学院把标准提高了，如果早知道标准提高，我还可以参加2009年最后一次英语四级考试。”

就不授予杨茂余学士学位一事，化学和生物学院院长欧阳艳表示，英语四级考试的成绩与学位证挂钩是伊犁师范学院的传统。“我们曾在2000年后尝试过两次不挂钩，结果主动报名参加四级考试的人寥寥无几。为了提高毕业生质量，学校恢复了挂钩制度。”

欧阳艳说：“我们学院英语四级考试成绩和学位证挂钩的分数线，基本上是逐年上升的，学校规定，各学院必须在全校的基础规定上有所上浮，比如去年院里划定的分数线是320分，今年就必须在这个基础上提高一些。这个我们曾提前告诉过学生。”

至于328分的分数线，欧阳艳解释，这是“等英语成绩出来后，根据全院系总体水平来确定的。2009年毕业生的总体水平不错，所以我们把分提到了328分，按照这个标准，杨茂余所在的班只有两个人没有通过(另有3人绩点未达标)。”欧阳艳认为，对于一个有67名学生的班级来说，只有两个学生英语不过，限制已经很宽松了。

“和其他院系相比，我们院算是授予率很高的了。如果一定要百分之百通过，后面的教育就没法提升。我也知道拿不上学位证对孩子意味着什么，但是规定不能随便破例，学生因为这个找工作有困难，我们可以出面和用人单位协调，解释清楚没有学位证只是因为英文成绩。”

法院已立案 本月17日开庭

6月29日，杨茂余的代理陈小平律师向伊宁市人民法院递交了诉状，要求被告授予原告学士学位证书。“立案庭当时没有马上立案，大家形成了两种意见，一方认为应当立为民事案件，另一方则认为立为行政案件更恰当。最后法院告诉我，诉状可能会在审委会上提出来讨论决定。”陈小平说，立案庭的小争议进一步让自己意识到这是个棘手的案子。

7月2日下午，法院分别向原告、被告双方发送了传票，案由最终确定为行政诉讼。杨、陈二人感到欣慰，因为立案决定比他们的预料来得早。

杨茂余这些日子在网上查了不少国内类似的案件，大部分原告败诉，因为国家学位条例本身就没有对此做过具体规定，并允许各高校拥有对授予学位证附加条件的权利。“不管输赢，我都想伸张一次自己的权力，诉讼了至少还有机会，而放弃则意味着完全听天由命。”

2日下午，欧阳艳收到了传票，她说：“学生告学校这在伊犁师范学院的历史上应该是第一次。到时，我们有法律顾问全权代表学校出庭。可以肯定的是，学校会继续执行英语成绩和学位证挂钩的制度，绝不会因为此事而终止。”

此案开庭时间为7月17日。

挂、脱之争 新疆不是第一案

国家英语四级考试制度始于1986年。

考试设立之初，教育及考试主管部门并未附带四级考试证书要与学位证书“挂钩”的要求。而1980年颁布的《学位条例》，因为当时还没有设立英语四级考试制度，也就不存在要求二者挂钩的问题。

从1986年起，除北大、清华等少数高校外，全国绝大多数高校不约而同地选择了将学位证书和英语四级证书挂钩的办法。

伊犁师范学院化学和生物学院院长欧阳艳是该校1987届毕业生，她回忆说，自己当年毕业时学位证就已经和英语四级挂钩了。

欧阳艳认为坚持学位证和英语四级成绩挂钩的制度有益：“时代的发展要求和国际接轨，很多文献资料都是英文，不掌握好英文对个人的发展也是一种阻碍。现在学生中并没有形成主动学习英语的积极性，如果不加约束，英文作为大学生应当掌握的一种技能将会越来越倒退。”

2000年后，因学位证和四级证挂钩引发的官司开始见诸报端。部分专家、学生质疑此项校规“师出无名”，希望早日废止。2006年，湖北三所知名大学相继宣布取消英语四级考试与学士学位挂钩的规定，采取其他的方式敦促学生学好英语，这一举措在全国范围内引起了不小的争论。此后陆续有大学跟进取消或降低标准。

记者了解到，新疆大学、新疆医科大学、石河子大学等我区主要高校至今均实行学位证和英语四六级成绩挂钩的制度，其中新疆大学规定，本科学生英语四级分数须达到355分才授予学位证书，但该校同时规定，英语四级毕业后可补考两年，如果通过，同样可授予学位证书。

其中有学校表示，挂钩是必须的，关键在于学校怎么行使授予学位的自主权。“如果把标准定得太高，那可能导致大学四年学生的主要任务变成学习英语;而放得太松也不合适，会让与英文关联较大的学科学生在深入研究专业的过程中遭遇困难。这是比较极端化的两种情况，从当前的就业现实情况出发，学校尽可能地照顾绝大多数人，以便提高毕业生就业率。因为学位证在近几年仍然是用人单位甄别人才的一种简单模式。”首府一高校负责人说。
